Jesuit Priest Attacked by Sex Abuse Victim - California

William Lynch's life spiraled out of control in the 35 years since he alleges he and his brother were molested by a Jesuit priest: He struggled with depression, had nightmares and tried to kill himself twice. Authorities believe that anger and pain erupted when Lynch lured the Rev Jerold Lindner to the lobby of his Jesuit retirement home by pretending he had news of a death in the priest's family and beat him severely in front of shocked witnesses. Lynch, 43, was arrested Friday and booked on suspicion of assault wa deadly weapon for the May attack. He posted $25000 bail and will plead Not Guilty at an arraignment next month, his attorney, Pat Harris, told Associated Press. Lynch punched the 65yo priest repeatedly in the face and body after Lindner said he didn't recognize Lynch during a confrontation at the Jesuits' Sacred Heart retirement home in Los Gatos, said Sgt Rick Sung, Santa Clara County sheriff's spokesman. Lynch and his younger brother settled with the Jesuits of the California Province, a Roman Catholic religious order, for $625000 in 1998 after alleging that Lindner abused them in 1975 during weekend camping trips in the Santa Cruz Mountains. Harris alleged that the boys, who were 7 and 5 at the time, were raped in the woods and forced to have oral sex with each other while Lindner watched. Taking Action California

We would like the judge, who presided over this case, investigated for basing his custody decision on hearsay and an obvious oversight of factual information. It is a proven fact that child abuse is proven by testimony witness of people associated with the child such as; daycare providers, teachers, counselors, doctors and psychologists, all of which were presented in this hearing and ignored. The testimony also included the statement of a previous child, who was sexually abused by the accused, in an attempt prevent her sister from going through the abuse she suffered. Just Bee Aware, after reviewing this entire case, feels that; with the court's lack of attention to the evidence presented, the inadequacy of the minor's council, and the court's denial of the mother's right to due process, it is now time to take this case to the people of California. HORRIBLE! "My Daddy Ate My Eyes" (California father accused of biting out his 4-year-old son's eyes)

A court hearing for a man accused of biting out his 4-year-old son's eyes has been postponed. Deputy Public Defender Joel E. Lueck said in court Wednesday that Angel Vidal Mendoza is still recovering in the hospital after hacking his legs with an ax after the eye incident. Meanwhile, Judge Colette Humphrey issued a gag order prohibiting attorneys and investigators from commenting about the case. Mendoza's son is in the care of Child Protective Services. According to an affidavit, he told investigators "my daddy bit me on my eyes and hands." Members of the family declined to comment in Kern County Superior Court. Mendoza is accused of mayhem, torture and child cruelty. The next court date could be as early as Friday.

Vincent Turner, 31, of Oakland, faces life in prison when he's sentenced by Alameda County Superior Court Judge Cecilia Castellanos on June 25. Jurors, who deliberated for only one day, found Turner guilty of two counts of kidnapping for financial gain from the female body, two counts of forcible rape and one count each of forcible oral copulation, pandering and human trafficking. Prosecutor Sharon Carney said the girls were only 15 and 16, respectively, at the time of the crimes in April 2009. Carney said Turner specifically picked minors to force into prostitution "because they were easier to take advantage of and intimidate." Oakland Police officer Jim Saleda has been working with sexually exploited minors for 10 years. "Pimps are the worst kind of predators," said Saleda, the police investigator, who worked on the case that resulted in Turner's conviction. "They abuse the girls and then send them out for other people to abuse them." He said Turner also chased the girls with pit bull dogs. "These are kids who have no one and no where to go," said Alameda County District Attorney Nancy O'Malley after announcing Turner's conviction. O'Malley has steered resources toward the conviction of traffickers and toward providing resources for children who are victims. "We've set out on a mission," she said, to rescue these kids and convict perpetrators and engage the community.

Law Fun Facts - Dumb Laws In California

Humor can come from anywhere. Humor is something that everybody likes.

Interestingly, humor can also come from the laws made by human.

Sometimes, these laws become so dumb and unexplainable that they generate humor. This time, we have come up with some of the laws in California.

Here is a list of some of the 'great laws' in California:

o You are not allowed to leave your car alone for the entire night until you have permission for it.

o In Arcadia, peacocks are allowed to cross any street they wish. That includes driveways too.

o In Baldwin Park, it is illegal to drive a bike in the swimming pool.

o In Belvedere, any dog must not be seen on the road without its owner on the leash.

o In Blythe, you can not put on a cow boy cap until and unless you own at least two cows.

o In Burlingame, you are not allowed to spit anywhere but on baseball diamonds.

o In Cathedral city, it is illegal to sleep in a vehicle when it is parked.

o Bicycles are not allowed to go through "Fountains Of Life".

o It is illegal to bring your dog to your school.

o In Cerritos, you have to remove all dog waste necessarily. This must be done within seven days.

o In Chico, you can own a green animal hide.

o You can not bowl on side walk.

o You can not drive a herd down the street.

California Child Custody - Who Gets Custody?

Like most states, the standard for child custody determinations in California is the overall best interest of the child with an emphasis on assuring the "health, safety, and welfare" of the child and "frequent and continuing contact" with both parents absent child abuse, domestic violence, or where the contact would not be in the best interest of the child as provided in the California family code section 3011 (See California Family Code Section 3011, 3020, 3040, 3080). Further, according to California family code section 3040, child custody should be granted in an order of preference and according to the best interest of the child.

A common challenge for the court is to decide who will get custody of the child. Child custody may be petitioned by parents, grandparents, stepparents, or any person who believes they can provide suitable care and guidance to the child. So how does the California family court or a California judge handle competing persons seeking custody of the child? According to California family code section 3040, child custody should be granted in an order of preference and according to the best interest of the child. The court looks first to grant custody to both parents jointly or to either parent before looking to grant custody to other persons. California however does not currently establish a preference or a presumption for or against joint custody arrangements. Instead, it allows the California family court or California judge to make the parenting arrangement decision on a case-by-case basis according to what it believes reflects the overall best interest of the child. If neither parent is granted custody, then the court may look towards the person's home in which the child has been living and the stability of that environment and then to any person deemed by the court to be able to provide appropriate care for the child. In short, the court will typically look to grant child custody first to the parents according the best interest of the child and if they are deemed unfit the court will then look to grant child custody to other persons according to the best interest of the child.
